These terms apply to MS Rollout (the mobile app and the web portal), the "Service," provided by Marc Robitaille, doing business as MS Rollout ("we," "us"). By using or buying the Service, you agree to them.
The Service
MS Rollout provides estimating, quoting and online quote approval, dispatch, crew location during dispatches, proof of service, time tracking, messaging and export tools for snow removal, landscaping and paving contractors. An account is created for a company; its managers add people (seats) for their team, up to the number of seats in their plan.
Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle handles payment, billing and sales tax, and its buyer terms also apply to your purchase.
Current prices are listed on our pricing page, in US dollars; any applicable tax is shown at checkout.
Subscriptions
New MS Rollout companies start with a free trial of 90 days, with 20 seats. No card is needed and nothing is charged during the trial, which starts when the company's email address is confirmed. If you have chosen a plan, the first payment is taken when the trial ends, unless you cancel before then. If the trial ends and no plan is chosen, the rules below for a plan that ends apply.
Plans are subscriptions, billed monthly or yearly in advance, that renew automatically until cancelled. You can cancel at any time; the plan stays active until the end of the period already paid for and is not renewed after that.
The Company plan includes 1 seat, and you can add as many extra seats as you need. A seat is one person who signs in to the app. Seats you add are charged right away, pro-rated for the rest of the current billing period. Removing seats takes effect at the renewal, and nothing is refunded. A person whose seat ends can no longer sign in; what they recorded stays with the company.
If a payment fails, the full service continues for 14 days while the card is retried. If a plan or free trial ends and no new plan is chosen within 60 days, the company account and its data may be permanently deleted; the managers are warned by email before that happens.
Price changes
We may change our prices. A new price applies to new purchases straight away. If we change the price of your existing subscription, we will email the company's managers at least 60 days before it applies; the new price is then charged from your first renewal after that date. If you do not want to pay it, you can cancel before then and you will not be charged the new price. A price decrease may apply sooner.
Refunds
Refunds are covered by our Refund Policy, including a 30-day money-back guarantee on your first payment. A refund or a chargeback ends paid access.
Your data
The records your company keeps in MS Rollout (customers, sites, drawings, estimates, visits, photos, hours, messages) are yours. We use them only to provide the Service, as described in our Privacy Policy. For the personal data of your customers and workers in them, you are responsible for it and we process it on your behalf, only to provide the Service. You can export them from the web portal, and ask for a copy or for their deletion.
Measurements, quotes and records
Areas, lengths, quantities, tonnages and prices calculated by the Service are estimates based on what is drawn and entered, and satellite imagery may be out of date. Check them before quoting or ordering material; you are responsible for the quotes you send and the work you do. Visit records, photos and positions are kept as you and your crews record them; they are not legal advice and do not replace insurance.
Acceptable use
Use the Service lawfully. Keep your sign-in details private and do not share accounts. Tell the people in your company that the app shares their position with the company at every sync while they are signed in (also from the background check about every 15 minutes with the app closed), and more often during dispatches, as described in our Privacy Policy, and get any consent the law requires. Send customer messages only to people who expect them. Do not try to break, overload or copy the Service.
No warranty
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee it will be uninterrupted, error-free or available at all times; GPS accuracy, connectivity and job-site conditions are outside our control.
Data loss
We take reasonable measures to protect your data, but we are not responsible for loss, corruption or unavailability of content, however caused, including device failure, connectivity loss, removal of a seat or account, or service interruption. Keep your own exports of anything you consider critical.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue or business, arising from your use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
Termination
You can stop using the Service and cancel at any time. We may suspend or end access for a breach of these terms or non-payment, with notice where practical.
Changes
We may update these terms; the date above shows the latest version. Important changes are announced to the company's managers by email or in the app. Continued use after a change means you accept the updated terms.
